User Agreement

By commissioning me, you agree that you are at least 18 years of age and have read and accepted all the terms describered herein.
You agree to using your commissioned work for personal, non-profit purposes only, unless discussed otherwise.
Breaking ToS may cause you to be added to my blacklist indefinitely and without warning.YOU ARE NOT PERMITTED TO USE OR SELL MY WORK AS NFT OR THE LIKE.YOU ARE NOT PERMITTED TO UPLOAD MY ARTWORK TO, OR ALTER IT WITH, AI SERVICES.

Client

- The client is expected to read and understand my ToS before contacting me, let alone before paying for my services.- The client is permitted to use, share and display the commissioned work, so long they don't remove my signature on said work. Credit is appreciated, but not always* necessary.- The client is not permitted to change or modify the commissioned work without explicit permission. Cropping for avatars, headers and the like is acceptable. *If you happen to crop out my signature, credit becomes necessary.- The client is not permitted to use the commissioned work commercially, unless discussed otherwise.
Permission for commercial use will affect pricing.

Things I consider non-commercial use: profile pictures, headers, character sheets for roleplay, ToyHouse profiles, phone and computer backgrounds, etc.Things I consider commercial use: anything relating to Twitch or YouTube (regardless of your viewcount), book-, magazine-, comic covers, merchandise, videogame assets (including concept art), etc.If you are unsure if your intended use is commercial, feel free to contact me.

- The client is permitted to have the commissioned work printed by a third party (as poster, on a t-shirt, pillowcase, etc.) or print it out themselves for personal use only, unless discussed otherwise.- The client is not permitted to upload the commissioned work to galleries intended for their own personal art (e.g. DeviantART, ArtStation), nor to claim the commissioned work was made by them.- The client is not permitted to 'finish' sketch or linework commissions, including sketches and lineworks from cancelled commissions, unless discussed otherwise.- The client is expected to hold onto the file of the finished artwork themselves, as I cannot guarantee to be able to re-send said file several years down the line. (However, you may still try to contact me in case of an 'emergency', I just can't GUARANTEE anything.)- The client is expected to be aware of their financial situation BEFORE contacting me. Having to refund a commission because you made an impulsive choice is a pain in the ***. Art is a luxury good, so please make sure you have the necessary funds before commissioning artists!

Artist

- Prices are non-negotiable. If anybody is going to make price suggestions that differ from my listed prices, it is going to be me.- I reserve the right to decline any project or client for any reason.- I reserve the right to post (or not post) the finished artwork to my social media, as well as the right to stream the process of it on Twitch or Picarto respectively. (See "NDA/Privacy Request" below)- I reserve the right to refund you the full or partial amount (depending on my progress) for any reason.

Refund percentages based on progress:Not started yet: 100%
Sketch finished: 60%
Linework finished: 40%
Base colouration finished: 20%

- After completion of the artwork there is no way to receive a refund.- I reserve the right to take up to 3 months per commission. It is highly unlikely, but I do wish to have as little pressure as possible.- Any specific deadlines have to be discussed immediately upon first contact, and not a few days before said deadline.

Copyright

- I retain the copyright over all of my work while you only receive the right to use the commissioned work for the discussed purposes.- I reserve the right to use my work as advertisement / promotion for myself, unless discussed otherwise. You will always be credited as the owner of your character(s).

NDA / Privacy Request

- If you wish for your commission to be private, it must be stated during the ordering process.
You will be charged an extra +5%.- The privacy request entails that I am not allowed to share any WIPs on social media, nor am I allowed to stream the process of the commission anywhere, nor will I post the finished artwork to my social media, unless discussed otherwise.

Ordering & Drawing Process

0. Collect any and all information, reference images, thoughts you have regarding your order. The more information you can give me, the better.1. You go send me an e-mail including all of the above at [email protected].Please try to be as concise as possible to minimize misunderstandings. If you are unsure about something, or you wish to commission something other than the provided options, feel free to contact me.2. You will receive a reply from me discussing the details and confirming your order by sending you an invoice via PayPal.

Before confirming, I may ask follow-up questions and clear up any uncertainties I have.
If your character is very detailed or your request is outside of my comfort-zone, I will charge an additional fee for complex characters.

3. After receiving your payment I will start sketching.4. I will send you a watermarked version of the sketch for you to confirm and point out any details you wish for me to change. Please make sure to point out every and all things you are dissatisfied with at this point, as it will become harder to fix further down the line.
I will only do up to two major revisions of the sketch, after that only minor details can be fixed.5. Once the sketch has been confirmed and/or fixed, I will continue working until the piece is finished. You are free to request to see any further WIPs at this stage.
( But perhaps don't ask for a WIP every two hours. )6. The finished full resolution artwork will be sent to you as a .png.
At this stage I will only do colour corrections and fix inaccurate details that had previously been discussed.I will not redraw or change a completed commission, unless a new order is issued.

Payment

- It is expected that you pay the full price of the commission upfront. I will not start drawing until I have received 100% of the payment.- Payments are sent via PayPal. Note that my prices are in EURO €- If the payment is not made within 48 hours after placing the invoice, the commission will be cancelled.
Repeated counts of commissioning a project and failing to pay will result in blacklisting.

Disclaimer

Please note that all of my sales are digital artwork and you only pay for the service of me drawing a personalised artworks for you.
I am not required to ever ship any physical items to you.
There are no physical items to be shipped.

Chargeback

- You are required to contact me when you need to cancel your order with me. Do NOT issue a chargeback, just text me, it's no problem at all.- Purposefully issuing a chargeback without contacting me to cancel/refund a project will result in immediate blacklisting.

I am just a human like anybody else. If you have any issues with your order, just tell me and we can find a solution in a transparent and constructive way.

Scheduling & Deadlines

- I will try my best to respond to any inquiries as fast as possible.- If you have a deadline in mind for your order you must disclose it prior to payment.- I have the right to decline a project if I don't feel able to complete the order in the requested time.- If you don't provide a specific deadline, the deadline will always be 3 months from me receiving your payment.- It is the clients responsibility to ensure prompt communication. If I have been trying to contact you and have not received an answer, I will not be held responsible for any delays.- No harassment over my work speed or the order I complete commissions in will be tolerated, as long as I am still within the above mentioned 3 months or another specified deadline.
Harassing me will result in blacklisting.- If anything was to happen which would prevent me from finishing my commission in time, you will be notified asap.
